Terms of Service

Last updated: 2026. Please read these terms carefully before using Almost Fine Hustle.

1. Who you're contracting with

Almost Fine Hustle ("the Service", "we", "us", "our") is operated by Heather Andree ("the Seller"), a sole proprietor. By using the Service you are entering into an agreement with Heather Andree. If you do not agree to these terms, do not use the Service.

2. Acceptance of terms

By creating an account, making a purchase, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you are an individual, you confirm you are of legal age in your jurisdiction.

3. The Service

Almost Fine Hustle is a mobile-first web application that aggregates low-pressure gig opportunities, surfaces emergency resources, and provides community, tracking, and AI-companion tools intended to help overwhelmed individuals. The Service includes a free tier and an optional paid Premium tier with additional features.

4. Payments, billing, and subscriptions

Our order process is conducted by our online reseller Stripe. Stripe is the Merchant of Record for all our orders. Stripe provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation, and refund mechanics, please refer to Stripe's End-User Terms and our Refund Policy.

Premium subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price, unless cancelled before the renewal date. The lifetime option is a one-time charge with no recurring billing. You can cancel or change your subscription at any time through the customer portal linked from your account.

5. Acceptable use

You agree not to misuse the Service. Specifically, you will not:

  • Use the Service for any unlawful, fraudulent, or harmful purpose;
  • Send spam, harass other users, or post content that infringes any third party's intellectual-property, privacy, or other rights;
  • Attempt to interfere with the Service's security or availability, including probing, scanning, scraping, or introducing malware;
  • Reverse-engineer, decompile, or attempt to extract the source code of any part of the Service;
  • Resell, redistribute, or sublicense the Service or any portion of it, or circumvent any technical limitations or paywall;
  • Impersonate another person or misrepresent your affiliation with any person or organization.

6. Account credentials

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must provide accurate information when registering and keep it up to date. Notify us promptly if you believe your account has been compromised.

7. User content

You retain ownership of content you post (e.g. community-wall posts, tracker entries). You grant Heather Andree a limited, worldwide, royalty-free license to host, store, reproduce, and display that content solely for the purpose of operating and providing the Service.

8. Intellectual property

All right, title, and interest in and to the Service — including the software, design, copy, brand, and documentation — are and will remain the exclusive property of Heather Andree and her licensors. Subject to your compliance with these terms, you are granted a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose.

9. Generative-AI features

The AI Companion and any other generative-AI features ("AI Features") may produce outputs that are inaccurate, incomplete, biased, or otherwise unsuitable. AI Features are not a substitute for professional financial, legal, medical, or mental-health advice. You are responsible for your prompts, your use of any outputs, verifying accuracy before relying on them, and ensuring you have the rights to any input content you provide.

You must not use AI Features to generate illegal content, deepfakes, harassment, hate speech, malware, or to attempt to jailbreak or circumvent safety guardrails. We may filter, refuse, restrict, or remove outputs and may suspend accounts engaged in repeated or serious misuse. If you believe an output infringes your rights, contact us so we can review and take appropriate action.

10. Third-party content and opportunities

Gig listings, resources, and links to third-party services are provided as starting points, not endorsements. We do not employ you, vet employers, or guarantee pay, hours, safety, or eligibility. You are responsible for reading and complying with each third-party platform's own terms.

11. No warranty; service level

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. We do not guarantee uninterrupted, secure, or error-free operation of the Service.

12. Limitation of liability

To the maximum extent permitted by law, in no event will Heather Andree be liable for any indirect, incidental, consequential, special, or exemplary damages (including loss of profits, data, or goodwill) arising out of or in connection with the Service. Our total aggregate liability for any direct damages is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim, or USD 50, whichever is greater. Nothing in these terms excludes liability that cannot be excluded by law (including liability for fraud, death, or personal injury caused by negligence).

13. Indemnification

You agree to indemnify and hold harmless Heather Andree from and against any claims, damages, liabilities, and reasonable expenses (including legal fees) arising from content you post, your unlawful use of the Service, or your breach of these terms.

14. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if you (a) materially breach these terms, (b) fail to pay any amount owed, (c) create a security or fraud risk for the Service or other users, or (d) repeatedly or seriously violate our acceptable-use policy. You may stop using the Service and delete your account at any time from the account screen. On termination, your right to use the Service ends immediately; we will retain or delete your data as described in our Privacy Notice.

15. Changes to the terms

We may update these terms from time to time. Material changes will be announced in-app. Your continued use of the Service after a change takes effect constitutes acceptance of the updated terms.

16. Governing law and disputes

These terms are governed by the laws of the seller's jurisdiction of residence, without regard to its conflict-of-law principles. Any disputes arising out of or relating to these terms or the Service shall be resolved in the competent courts of that jurisdiction, except where mandatory local consumer law gives you the right to bring proceedings in your country of residence.

17. Assignment

You may not assign or transfer these terms without our prior written consent. We may assign these terms in connection with a merger, acquisition, reorganization, or sale of assets.

18. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, power or internet outages, or actions of governmental authorities.
